ClaimSafer™ Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the ClaimSafer™ platform ("Service") operated by Profortis, a company incorporated under the laws of the Netherlands, with its registered office at Zuiddijk 1, 5705CS Helmond, the Netherlands ("ClaimSafer", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms.

1. Nature of the Service

ClaimSafer™ is a regulatory intelligence platform providing structured access to curated and publicly sourced regulatory information relating to food health claims, ingredient status, and related compliance considerations.

The Service provides access to digital regulatory dossiers. Each dossier may include:

  • Structured regulatory data
  • Contextual summaries
  • Analytical explanations
  • AI-generated insights through CORTEX AI

The Service is intended to support internal research, product development, and regulatory assessment processes.

ClaimSafer does not provide:

  • Legal advice
  • Regulatory advice
  • Compliance certification
  • Official approval or endorsement from any authority

ClaimSafer is not affiliated with, endorsed by, or acting on behalf of any governmental or regulatory body.

2. Access Model (Pay-Before-Access)

Access to full dossiers and integrated CORTEX AI functionality is granted only after successful payment.

Before payment:

  • Only limited preview information may be visible
  • Full dossier content and AI features are restricted

After payment:

  • The user receives a limited, non-exclusive, non-transferable license to access the purchased dossier
  • Access is granted for internal business use only

ClaimSafer does not operate on a recurring subscription basis unless explicitly stated.

3. AI Functionality (CORTEX AI)

The Service includes AI-powered analytical functionality known as "CORTEX AI".

CORTEX AI generates structured summaries, contextual explanations, and analytical outputs based on regulatory data contained within the dossier and related structured information.

CORTEX AI:

  • Functions as a decision-support tool
  • Does not autonomously approve or certify compliance
  • Does not replace professional regulatory or legal review
  • Does not make binding compliance determinations

AI-generated outputs are probabilistic in nature and may contain inaccuracies or omissions.

Users acknowledge that:

  • AI outputs require independent verification
  • Regulatory interpretation may vary between jurisdictions
  • Final compliance responsibility remains with the user

ClaimSafer does not guarantee the accuracy, completeness, or suitability of AI-generated content.

4. No Legal or Regulatory Advice

All information provided through the Service, including AI-generated content, is for informational purposes only.

Users are solely responsible for:

  • Verifying applicable regulatory requirements
  • Assessing product claims and ingredient compliance
  • Ensuring compliance with EU and national laws
  • Seeking independent professional advice where necessary

Use of the Service does not create a lawyer-client, consultant-client, or advisory relationship.

5. Accuracy and Regulatory Developments

ClaimSafer strives to ensure that information is accurate at the time it is made available.

However:

  • Regulatory frameworks evolve
  • Interpretations may differ between Member States
  • Public data sources may change without notice

ClaimSafer does not guarantee that information is complete, current, or applicable to a specific commercial situation.

Users remain responsible for independently verifying regulatory requirements before relying on the Service.

6. Fees and Payments

All fees:

  • Are payable in advance
  • Are clearly displayed prior to purchase
  • Grant access to the specific dossier selected

Payments are generally non-refundable once the valid paid analysis output for the purchased ingredient × country has been delivered.

The affected purchase is refundable if ClaimSafer fails to generate or deliver the promised paid analysis output for that selected ingredient × country. This narrow exception concerns failure to deliver the purchased analysis, not the result of the analysis. An unfavorable or limited claim result is not a delivery failure. ClaimSafer does not guarantee regulator, retailer, advertising-platform, revenue, or commercial-success outcomes.

If payment is reversed or fails, ClaimSafer may suspend access.

7. Intellectual Property

All intellectual property rights in the Service, including:

  • Platform architecture
  • Database structure
  • Dossier formatting
  • AI models and analytical frameworks
  • Software systems

are owned by or licensed to ClaimSafer.

Upon payment, users receive a limited license for internal business use.

Users may not:

  • Resell or redistribute dossiers
  • Publish dossiers publicly
  • Represent ClaimSafer content as official regulatory approval
  • Reverse engineer or extract structured data at scale

8. Limitation of Liability

To the fullest extent permitted under applicable law:

ClaimSafer shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits or revenue
  • Business interruption
  • Regulatory fines or enforcement actions
  • Product recalls
  • Marketing or labeling decisions made by users

ClaimSafer's total aggregate liability shall not exceed the amount paid for the specific dossier giving rise to the claim.

This limitation applies equally to AI-generated outputs provided through CORTEX AI.

Nothing in these Terms excludes liability for:

  • Fraud or fraudulent misrepresentation
  • Death or personal injury caused by negligence
  • Any liability that cannot be excluded under applicable law

9. Indemnification

To the extent permitted by law, users agree to indemnify and hold ClaimSafer harmless from claims arising out of:

  • Product claims or labeling decisions
  • Regulatory violations
  • Misuse of the Service
  • Breach of these Terms

10. Service Availability

ClaimSafer aims to maintain reliable access but does not guarantee uninterrupted or error-free availability.

Temporary interruptions may occur for maintenance, updates, or technical reasons.

11. Data Protection

Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable national data protection laws.

12. Termination

ClaimSafer may suspend or terminate access if:

  • Payment obligations are not fulfilled
  • These Terms are breached
  • Continued access presents legal or operational risk

Provisions relating to liability and intellectual property survive termination.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands.

Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts of the Netherlands, unless mandatory law provides otherwise.
